The terms of Mida A/B testing platform

Welcome to Mida! These Terms of Service ("Terms") govern your access to and use of Mida's website (https://www.mida.so) and its A/B testing solution (the "Services"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree with any of these terms, you are prohibited from using the Services.

1. Acceptance of Terms

By using Mida's Services, you confirm that you have read, understood, and agree to these Terms. If you are using the Services on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

2. Description of Services

Mida provides an A/B testing solution that allows clients to test and optimize their digital experiences. Mida offers various subscription plans with different features and monthly tested users (MTU). By subscribing to a plan, clients gain access to the features and MTU associated with that plan. Upgrading or downgrading a plan may change the features and MTU available to the client. Details about the plans, features, and MTU are available on Mida's pricing page: https://www.mida.so/pricing

3. Subscription Plans and Billing

3.1 Subscription Plans

  • Clients may subscribe to monthly or annual plans as outlined on Mida's pricing page.
  • Subscriptions are auto-renewing. Monthly subscriptions renew at the end of each monthly billing cycle, and annual subscriptions renew at the end of each annual billing cycle.
  • Fees for monthly subscriptions are billed in advance on a monthly basis. Fees for annual subscriptions are billed in advance on an annual basis.

3.2 Payment

  • Clients must provide a valid payment method (e.g., credit card) for automatic billing.
  • If payment fails, Mida reserves the right to suspend or terminate access to the Services.

3.3 Upgrades and Additional MTU

  • MTU refresh on the 1st of each calendar month.
  • Clients can upgrade their subscription plan or purchase additional MTU at any time through their Mida account or by contacting Mida's support team.
  • If a subscription upgrade or additional MTU is purchased mid-billing cycle, the cost will be prorated based on the remaining days in the current billing cycle.
  • Rates for upgrades and additional MTU are as specified on Mida's pricing page.

4. Cancellation and Refunds

  • Clients may cancel their subscription at any time through their Mida account.
  • Cancellations will take effect at the end of the current billing cycle. No refunds will be provided for partial billing periods.

5. Data Processing and Privacy

Mida is committed to protecting your data. By using the Services, you agree to our data processing practices as outlined in our Privacy Policy and Data Processing Agreement (DPA). You acknowledge that Mida may collect, process, and store your data in accordance with applicable data protection laws.

6. Intellectual Property

All intellectual property rights in the Services, including but not limited to software, trademarks, and content, are owned by Mida or its licensors. Clients are granted a limited, non-exclusive, non-transferable license to use the Services in accordance with these Terms.

7. Third-Party Services

Mida's Services may integrate with or rely on third-party services, tools, or platforms. Mida is not responsible for the availability, functionality, or content of these third-party services. Your use of third-party services is subject to their respective terms and conditions, and Mida disclaims all liability for any issues arising from your use of such services.

8. Disclaimer

The Services are provided on an "as is" basis. Mida makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Furthermore, Mida does not warrant or make any representations regarding the accuracy, likely results, or reliability of the use of the materials on its website, the Services, or otherwise relating to such materials, or on any sites linked to this site.

9. Limitation of Liability

To the fullest extent permitted by law, Mida will not be responsible for any indirect, incidental, or consequential damages arising from your use of the Services.

Mida’s total liability for any claims will not exceed the amount you paid for the Services in the last month.

10. Modification
